Role Purpose
Develop and manage the execution of the compliance program to enable licence management of the FSP.
Requirements
At least 2 years in a supervisory or managerial position.
Proven experience in:
- Registered FSCA approved qualification - bachelor’s degree in law (LLB), Compliance, Risk Management, Business Administration, Finance, or a related field.
- Postgraduate qualification in Compliance, Risk, Corporate Governance (advantageous).
- Industry-specific regulatory certifications (RE5/RE1/RE3 for financial services).
- Compliance Institute Southern Africa (CISA) certification (Preferred).
- Registered Cat I & II Compliance Officer with the FSCA
- POPIA
- FICA
- FAIS
- NCA
- AML/CFT laws and crypto-asset-related regulatory guidance
- Sector-specific standards and regulatory requirements
- Crypto asset regulatory developments and global standards
- Developing and implementing compliance frameworks,
- Managing regulatory audits,
- Conducting compliance monitoring and reporting, and
- Drafting compliance policies and procedures. 10 years compliance related experience of which at least 5 years must be as a Cat II Compliance Officer.
Advantage -Experience working with Crypto Asset Service Providers, including:
- CASP licensing, registration, and reporting requirements,
- AML/CFT frameworks for crypto transactions
Duties & Responsibilities
INTERNAL PROCESS
- Develop and manage the implementation of a suitable compliance monitoring plan to ensure completeness and accuracy.
- Manage the review and provide oversight of the relevant compliance monitoring plan based on combined assurance initiatives.
- Manage the execution of compliance activities based on the compliance monitoring plan to provide assurance on the level of regulatory compliance.
- Ensure the regulatory compliance breach management and follow-up process is followed to enable business to effectively manage and resolve breaches.
- Monitor and provide the appropriate oversight function for any activities outsourced or for any independent compliance functions performed by any legal entities within the business.
- Monitor and communicate regulatory changes and actively influence the business to establish control frameworks.
- Manage the implementation of the compliance requirement universe for the business.
- Provide professional advice and guidance to the business and senior business leaders regarding compliance matters.
- Contribute to the initiation of critical statutory projects relevant to the business and monitor the appropriate implementation thereof by the business.
- Create awareness within the business regarding new compliance requirements or provide guidance on potential impact of compliance requirements.
- Support the business stakeholders in identifying compliance risks or weaknesses for which the business should consider additional mitigating action, or processes and/or procedures.
- Initiate, contribute and prepare the necessary documentation for the submission of business enabling statutory applications to applicable regulatory and industry or supervisory bodies.
- Build relationships with internal and external stakeholders.
- Act as adviser into the business projects and initiatives as is related to the compliance eco-system.
- Manage the delivery of compliance reports that highlight compliance activities and instances of non-compliance, both internal and external within agreed time frames.
- Initiate and contribute to the review of all critical business policies from a regulatory compliance perspective and make recommendations for improvement.
- Compile, submit and present compliance reports required by the business and stakeholders.
- Manage and execute the process to identify, manage, monitor and report compliance risks that the organisation face.
- Apply a combined assurance model in optimising assurance coverage in the organisation.
- Continuously align compliance landscape to the business strategy to ensure that the function is geared towards enabling business to reach its objectives.
- Act as trusted adviser for Ombudsman related queries and escalations related to the compliance matters.
