Job Purpose
To oversee the provision of legal advice to Heads of Department, ensure that the Ministry complies with labour laws, draft legislation, review policies and ensure that the Ministry is represented in legal matters. Advise Heads of Departments on matters bearing a juristic nature and requiring legal opinion.
Main Duties
- Tenders Legal Advice to the Principal Secretary and All the Ministry’s Departments
- Analyses legal advice requests from management and the Ministry’s departments.
- Implements management decisions as per legal advice.
- Conducts research on identified legal issues.
- Provides legal advice on human resource-related issues.
- Provides Legal Opinion to Departments on National and International Instruments
- Analyses national and international instruments, documents and agreements.
- Identifies legal issues relating to national and international instruments, documents and agreements.
- Provides legal advice and opinions to the concerned departments.
- Drafts Labour Legislation
- Participates in the drafting, review and amendment of legislation and internal policies to align them with international standards.
- Coordinates consultations with all relevant ministries and departments.
- Provides drafting instructions to the Law Office.
- Follows up on the drafting of Bills.
- Prepares Cabinet Memoranda and accompanying documentation.
- Coordinates Drafting of Contracts and Agreements Between the Ministry of Labour and Employment and Other Parties
- Participates in contract and agreement discussion forums.
- Advises the Ministry on all contracts and agreements entered into.
- Coordinates Representation of the Ministry in Litigation
- Analyses the nature of legal cases.
- Coordinates and assigns the Ministry’s legal team to support all litigation.
- Liaises with the Attorney General’s Office.
- Oversees Compliance with Court Judgments
- Advises management to direct the relevant department to comply with court judgments.
- Makes follow-ups to ensure that the affected department complies.
- Coordinates State Reporting Process
- Ensures accuracy and consistency in country reports submitted on ratified conventions.
- Advises the Ministry on observations and recommendations issued by the supervisory body.
- Establishes Feasible Options to Enhance Performance of the Legal Unit
- Draws the annual work plans for the Legal Unit.
- Conducts quarterly appraisals for Legal Unit staff.
- Compiles progress reports from Legal Unit staff.
- Produces quarterly reports and submits them to the Principal Secretary.
Job Specification
Applicants must possess either
- LLM plus three (3) years’ working experience as Chief Legal Officer.
OR
- LLB with at least five (5) years’ working experience as Chief Legal Officer.
Responsibility For Work Of Others
The incumbent has responsibility to supervise and direct all Legal Unit staff.
Responsibility For Safety
The incumbent is responsible for the safekeeping of valuable assets and documents within his/her custody.
Responsibility For Safety Of Others
The factor is considered to be minimal in this job.
Complexity
The job demands the ability to read comprehensive documents addressing varying complex issues such as legal cases, international instruments and agreements.
Authority For Decision Making
The incumbent is responsible for advising the Ministry’s management and departments on legal matters.
Problem Solving
The incumbent is responsible for proactively addressing legal challenges within the Ministry and ensuring compliance with labour laws, financial rules and regulations, the Constitution of Lesotho, the Public Procurement Act and Public Service regulations.
Dexterity
The incumbent advises on legal matters at ministerial level. The job requires enormous skills, mental concentration and visual attention.
